A small warning about Covid-19 and tenanted properties. If you are currently selling a property that is tenanted, we recommend that you insist that the property is sold “subject to lease” even if your tenant is on a month-to-month lease. This is because at the moment it is not possible for an owner to serve on a tenant a Notice to Vacate pursuant to sale, with the process instead now requiring a landlord to proceed only through a tribunal order. The turnaround for property searches from authorities such as council, land tax, water and owners corporation certificates are currently being affected by the Covid-19 crisis. Typically, the searches will at most take 10 business days to obtain. This mostly affects sellers who wish to urgently prepare a proper S32 Statement for putting their property on the market. Victoria currently has stage 3 restrictions in place, this excludes removalists who are deemed essential logistics services. So far, we have not had any reports of clients experiencing difficulty with moving in or out of properties. If stage 4 restriction are announced, which is highly unlikely at this point in time, then some removalist businesses may be affected. We advise that all our clients pay close attention to news development over these times. There have been reports on some additional restrictions and requirements in place for approvals to move in and out of unit buildings, we advise that anyone affected by this should contact their owners corporation managers for specific building information. At Anchor Conveyancing, the health and safety of our clients and staff is of the utmost importance which as a result we are currently working remotely.
